These general terms and conditions of sale (hereinafter referred to as the ‘GTCS’) define the legal framework for the relationship between Alex Ski School and its clients (hereinafter referred to as the ‘Client(s)’).
Alex Ski School and the Client may hereinafter be referred to jointly as the ‘Parties’ or individually as a ‘Party’.
The purpose of the General Terms and Conditions is to define all the conditions under which Alex Ski School markets its services (hereinafter referred to as the ‘Services’), which are available by registration only.
They therefore apply to all sales of Services made to Alex Ski School.
Consequently, placing an order implies full and unreserved acceptance by the Customer of the GTCS.
The Customer declares that he/she has read the GCS before booking and purchasing the Services and accepts them without restriction or reservation, in all their provisions.
In the absence of the express acceptance of Alex Ski School, any condition imposed by the Customer which is contrary to the GCS will therefore be unenforceable against the latter, regardless of when it may have been brought to its attention.
The GCS may be updated; however, the applicable GCS are always those in force at the time of purchase of the Services.
The Terms and Conditions are available at all times on the Alex Ski School website.
Learning to ski takes place in a specific, unpredictable environment. It therefore requires the student to take personal responsibility for their own safety and that of others.
The instructor's responsibility is limited to an obligation of means. It is the student's responsibility to follow the instructor's instructions. Students are solely responsible for their own equipment. The instructor is not responsible for accidents caused by skiers taking part in the lesson.
Participation in the teaching services requires :
The Client acknowledges having full knowledge of these conditions for participation in the Services.
The Client releases Alex Ski School from all claims and legal action relating to injury or damage caused to him/herself and/or to third parties and caused in any way whatsoever, arising from or as a result of his/her participation in the subscribed Services.
Alex Ski School is a professional holder of the Brevet d'Etat d'Educateur Sportif du Premier Degré (BEES 1er Degré), n°38/06.0011 issued on 23/01/2006 by the Direction Départementale de la Jeunesse et des Sports.
All participation in the Teaching Services is subject to the assessment of the moral and physical aptitudes of the students.
The feasibility of any lesson is subject to the assessment of Alex Ski School according to weather conditions, snow conditions and the ability of the participants.
Alex Ski School has a telephone link with the slope services of the Portes du Soleil resorts.
Helmets are compulsory for children and strongly recommended for adults.
Under no circumstances can weather conditions be a reason for the Customer to cancel or postpone the Services, as long as the Services are provided by Alex Ski School.
For this reason, the Customer may not claim any reimbursement for the Services booked or postponement of their execution.
The Teaching Services do not include insurance.
The Client is therefore informed that it is their responsibility to take out a personal insurance policy covering at least bodily injury to which they may be exposed as a result of their sporting activities, in accordance with article L. 321-4 of the French Sports Code, and possibly cancellation of lessons, medical assistance and repatriation costs, including during the Provision and including on Swiss territory.
Alex Ski School has taken out Professional Civil Liability insurance (n°110329692204SIMS, GBC MONTAGNE, 298 av. du Maréchal Leclerc, 73700 Bourg Saint Maurice), it is therefore covered against damage to third parties as well as to the participants during the time they are under its authority.
As part of the teaching services provided by Alex Ski School, students may be required to ski in cross-border ski areas and thus cross the Swiss border within the limits of the ski area. The Customer must therefore be in possession of identity papers.
Any dispute relating to the above must be made in writing to Alex Ski School by the legal guardian(s) of the pupil concerned.
Services may only be ordered by email (contact@alex-skischool.fr).
The possibility of booking Services is subject to their availability and consequently to their validation by Alex Ski School.
The Customer may order Services on his/her own behalf or on behalf of one or more relatives; in the latter case, the Customer acknowledges that he/she has received authorisation from this relative to use his/her personal data and to subscribe to Services on his/her behalf.
The Customer is solely responsible for the truthfulness and accuracy of the information he or she provides when booking Services on his or her own behalf and/or on behalf of close relations.
The Customer may not assign or transfer to anyone else in any way whatsoever, whether free of charge or against payment, any Teaching Service subscribed to in his/her name or in the name of a relative.
Services are payable in full at the time of booking.
The following methods of payment are accepted: bank transfer, cheque, cash.
The booking of Services only becomes definitive once full payment of the corresponding price has been received and validated by Alex Ski School.
Any order implies express and irrevocable acceptance of the prices and descriptions of the Services, as well as the General Terms and Conditions.
The right of withdrawal provided for in article L 221-21-28 of the French Consumer Code for the benefit of consumers in the context of distance selling does not apply to the Services offered:
‘The right of withdrawal cannot be exercised for contracts :

12° Accommodation services, other than residential accommodation, goods transport services, car hire, catering or leisure activities that are to be provided on a specific date or during a specific period’.
If you cancel your booking in advance, the charges will be deducted as follows:
No refund or postponement of the Event:
Any Event interrupted or not completed due to an insufficient physical and/or technical level of the participant;
Any interruption to the Services beyond the control of Alex Ski School (ski lift stoppage, bad weather, security measures, etc.);
Modification or cancellation by the instructor, with or without prior notice, of the Services for reasons relating to weather or safety conditions;
The timetable for the provision of Services may be modified according to the opening and closing times of the ski lifts without any participant being able to claim any compensation whatsoever.
Alex Ski School may be obliged to cancel the Teaching Services booked by a Customer in the event of unforeseeable unavailability without the possibility of replacing the instructor immediately: in this case, the Customer will be reimbursed the full amount paid for the Service in question.
The prices of the Services offered on the Alex Ski School website are quoted in euros and include all taxes.
The prices of the Services are those in force at the time of the registration requested by the Client.
Alex Ski School reserves the right to increase its prices at any time; the price increase will take effect on the date of publication of the new prices online.
The prices indicated for the Teaching Services do not include insurance, the necessary equipment or the ski pass.
In order for the Services purchased to be carried out correctly, the Customer undertakes to provide truthful and sincere information during the ordering process and subsequently to comply with the instructions given to them in the e-mail confirming their booking, in particular with regard to the place, day and time of the appointment for the start of the Teaching Services.
In the event of a delay in arriving at the agreed meeting point, the Customer will not be entitled to any reimbursement, even partial, of the price paid, or to any compensation.
Alex Ski School collects the personal data of the Client and/or those close to the Client through the Client's intermediary for the sole purpose of responding to requests for information and booking of Services, for the follow-up of files, for the correct maintenance of its accounting and IT databases and its schedules and/or for the purposes of commercial follow-up (in particular administrative, accounting, commercial and statistical management) or information on the latest news from Alex Ski School and its Services.
Personal data is collected within the limits of the information that is strictly necessary for Alex Ski School to carry out its Services and, more generally, to comply with the GTC.
This personal data remains strictly confidential.
In application of the Legislation relating to personal data, the individuals concerned by the data collected by Alex Ski School have the following rights:
The individuals concerned may exercise all of these rights at any time with Alex Ski School by sending a request by post (Alex Ski School, 114 chemin de la Coudre, 74430 Le Biot) or by email (contact@alex-skischool.fr). Alex Ski School will respond to requests from the individuals concerned as quickly as possible and in accordance with applicable law.
The data collected by Alex Ski School is kept for the prescribed legal period.
Alex Ski School undertakes not to infringe on the privacy of Users and to take all necessary precautions to preserve the security and confidentiality of their personal data and in particular to prevent it from being modified, damaged or communicated to unauthorised persons, subject to any obligations that may be incumbent upon it under the terms of Law No. 2004-575 of 21 June 2004 for Confidence in the Digital Economy.
All provisions of the GCS are subject to French law and are interpreted in French.
In the event of a dispute, after having referred the matter to Alex Ski School by registered letter with acknowledgement of receipt, and in the absence of a satisfactory response or a response within sixty (60) days, the Customer may refer the matter free of charge to the Consumer Ombudsman, whose contact details are available on his website: www.mediateur-consommation-smp.fr.
